Which rules actually apply - and why most articles get it wrong

The code in force is the Indian Medical Council (Professional Conduct, Etiquette and Ethics) Regulations, 2002, now administered by the National Medical Commission.

Replacement regulations - the NMC Registered Medical Practitioner (Professional Conduct) Regulations, 2023 - were notified on 2 August 2023 and placed in abeyance by a Gazette amendment dated 23 August 2023. No later notification has lifted that abeyance, so the 2002 code is what applies today. Most agency articles on medical marketing still quote the 2023 rules as though they were live.

The restriction that matters is Clause 6.1.1:

Soliciting of patients directly or indirectly, by a physician, by a group of physicians or by institutions or organisations is unethical.

That rules out marketing which invites attention to your skill or achievements, promises about outcomes, and promotional use of patient testimonials. What it does not rule out is a website that tells patients factual things - your qualifications and registration, what you treat, where you are, your timings, your fees, and how to book. Factual announcements and patient education sit on the permitted side of the line.

What is not included

Photography
We will tell you exactly which shots you need and can recommend a photographer, but the shoot is billed separately.
Domain
About ₹1,200 a year, paid directly to the registrar. We register it in your name from day one so it stays yours, and we handle the setup.
Ad spend
If we run Google Ads, the budget goes to Google. Our fee covers managing it.
Medical accuracy
We write the content; you review and approve it. Clinical accuracy remains yours.
Payment gateway account
The gateway account - Razorpay, PayU, Cashfree or similar - is opened in your clinic's name and KYC'd to you. We integrate it. Patient payments go directly to your account and never pass through us. Transaction fees are set by the gateway.
Booking and messaging subscriptions
Where appointment booking or automated reminders run on a third-party platform, that subscription is billed to you directly. We set it up, configure it and hand it over.

For the Jupiter Cancer Institute in Indore we built a complete oncology site: six treatment areas explained in patient language, seven consultant profiles, and an appointment form that captures the area of concern and a preferred call-back slot - so the team knows who they are calling and why before they pick up the phone. Questions doctors ask

A single-doctor one-page site is live in 48 hours, counted from the moment we have your content and photos in hand. Multi-doctor clinics take longer because there is more to gather - profiles, treatment pages, department structure. The timeline depends more on how quickly we get your photos and approvals than on the build itself, so we tell you upfront exactly what we need from you and when.

Hosting and technical support are included for your first year. After that, hosting is about ₹4,000 a year and the domain about ₹1,200, both paid directly to the provider. The domain has been in your name from the start, so nothing transfers and nothing is held back. If you want us to keep handling technical support beyond year one we will quote for it, but there is no automatic renewal and no lock-in.

Included. Anything that stops the site working - hosting problems, DNS issues, SSL renewal, the site being down or slow, forms not delivering. We reply within two working days and we fix it.

Quoted separately. Content changes, new pages, redesigns, new features and third-party integrations. Your site is built as static HTML, so it is fast and there is very little that can break - but that also means text edits come to us rather than being done from a dashboard. We will tell you what something costs before we start.

Sometimes. If the underlying site is sound and the problem is design, speed or missing booking, fixing it is cheaper and faster than starting again. If it is built on something we cannot work with, or it is slow in ways that cannot be patched, rebuilding costs less than fighting it. We will tell you which after we look - that is what the free review is for, and we will say “keep what you have” if that is the honest answer.

We write it, and it is included in the price. You spend an hour or two with us explaining what you treat and how you work, and we turn that into the site copy - treatment pages, your profile, patient-facing explanations. You review and correct everything before it goes live, because the clinical accuracy has to be yours. Most doctors find it far easier to talk for an hour than to write anything.

Yes - we have done it. Booking systems, appointment software and EMR platforms can usually connect to your site so patients book into your existing calendar instead of into a separate system your staff has to re-enter. What is possible depends on which platform you run and whether it offers an API or an embed, so tell us what you use and we will confirm before quoting.

No, and that is deliberate. Appointment booking and payments run on established platforms - a booking system that has already handled millions of appointments, and a payment gateway regulated to hold money. We choose them for your practice, configure them around your timings and fees, and connect them to your site so patients never feel they have left it.

The alternative is a booking engine we wrote ourselves, which would be one more thing that can break on a Sunday evening. Established tools are the safer answer for a clinic.

Yes, with real limits, and they matter.

We build to that line. We are not lawyers and we do not certify compliance - no agency can, because the NMC regulates practitioners, not marketing vendors. What we do is write factually, avoid superlatives and outcome claims, keep testimonials off your site, and flag anything sitting close to the line so you can decide with your council or your advisor.
